Matric Works is an innovative online learning program offered by Interactive Tutor, trading as Media Works (henceforth referred to as “Media Works”). Matric Works allows qualifying learners to complete their matric through our online learning channels, preparing them for writing their Amended Senior Certificate examinations in pursuit of the nationally recognized matric qualification, the Amended Senior Certificate.

 

Use of Site 

 

Users may only use this site to browse the content and make legitimate purchases. Users are not to use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase(s). This site and the content provided herein may not be copied, reproduced, republished, uploaded, posted, transmitted or otherwise distributed. ‘Deep-linking’, ’embedding’ or using analogous technology is also strictly prohibited. Any unauthorized use of this site and/or the materials contained herein may constitute legal violations, and as such, the appropriate legal actions will be taken against unlawful users.

When you confirm a purchase with us, legal obligations arise and your right to refunding of monies (whether charged to your credit card or in any other way paid) is limited by our Terms & Conditions. You must not make any purchase through this site unless you understand and agree to all of our Terms and Conditions. Once payment is made for a purchase, it is deemed that you have read and understood these terms and conditions for such a purchase. Enrolment & Registration

 

Media Works makes no representations and gives no guarantees whatsoever regarding learners’ suitability for a particular course based on the levels of difficulty and/or complexity of and/or any pre-requisites for participation in the courses. Any questions around the level of difficulty of a course must be addressed in writing, prior to enrolment for such a course in order to settle any uncertainty surrounding the learner’s ability or readiness, and Media Works shall accept no responsibility in this regard.

 

If specifically requested by you in writing prior to enrolment, Media Works may at its sole discretion endeavour to attempt to cater for any special needs and/or disabilities that learners may have, but you hereby accept and agree that Media Works shall be under no obligation whatsoever to make any such provisions and/or exceptions, and you hereby agree to hold Media Works and its members, directors, employees and agents completely harmless for any claims relating hereto.

 

Order Processing 

 

No orders will be processed until orders are fully confirmed and payment is received in full. Please contact tshilidzi@mediaworks.co.za with any sales- or payment-related queries.

 

Refunds/Cancellation Policy 

 

If you have placed an order and chosen EFT as your payment method, you are able to cancel that order before payment is made my clicking on “My Account”, going to your “Order History” and clicking on “Cancel Order”.

 

However, once payment is made, learners can only cancel their orders under the following circumstances:

 

  1. a) Payment has been made and the Order has been confirmed. The learner has received an email containing their iTut login information, but they have not logged into iTut yet or begun using any of the course content. If this is the case – contact us to Cancel your order. Do not login to iTut or open any of the course content.

 

  1. b) Payment has been made and the Order has been confirmed. The learner has received an email containing their iTut login information and they have logged in and begun using the course content. If this is the case – contact us to Cancel your order. Your access to iTut and any course content will be revoked and you will incur an admin fee of 5% of your Order total. Please note that customers can only cancel their Orders under these circumstances up to 10 calendar days after their order is confirmed and their iTut account is activated.

 

Should you for any reason wish to cancel or refund your purchase, you are required to advise us in writing at tshilidzi@mediaworks.co.za within the stipulated time period. Thereafter, no cancellations or refunds will be accommodated.

 

Cancellation by Media Works

 

Media Works may, in its sole discretion elect to discontinue any of the courses by giving you notice of 10 (ten) calendar days. In such an event, we shall refund the amount paid by you in full within 60 (sixty) days of such cancellation and you agree that you shall hold Media Works and its members, directors, employees and agent completely harmless in respect of any claims which arise out of such a cancellation.

 

Payment Options and Pricing 

 

All prices quoted on our site are exclusive of Value-Added Tax (VAT). VAT is calculated at 14% and added to your order to make up your order Total. You will receive an Invoice from Matric Works when you have placed an order. This invoice will contain all of the details of your order as well as information on how to pay.

 

All transactions will be processed in South African Rands (ZAR). The total price of your order includes VAT. We reserve the right to change pricing at any time without notice.

 

All prices for all subjects or courses are as they are stated on our website, unless in the case of obvious error. Media Works endeavors to display all prices accurately and clearly, however should courses or subjects be erroneously offered at incorrect prices, Media Works will not be obliged to offer them at those incorrect prices, but shall refund monies paid by you should you not wish to proceed with the course at the correct price.

Security Policy 

 

As an online merchant, Media Works is committed to providing secure online services. Encryption is used to protect the transmission of personal information when completing online transactions, and all encryption complies with international standards. We, the Merchant, do not have access to credit card details or any sensitive banking information.

 

Monitoring 

 

We have the right, but not the obligation, to monitor any activity and content associated with this Website. Accordingly, we may investigate any reported violation of these Conditions or complaints and take any action that we subsequently deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from this Website).

 

Access

 

Media Works endeavors to ensure that the online availability in respect of the course platform, iTut, is available at all times. However, we make no guarantees that either the site and/or the platform through which the courses are provided will be available and error free at all times. Media Works shall not be held responsible for any loss, disruption of or interruption in learners’ participation in the courses and any damage or loss resulting therefrom caused either by any technical error with its site and/or any other website and/or by your computer and/or as a result of a disruption of your access to the internet.

 

Media Works endeavors to ensure that support agents are available to address your questions between 09h00 and 17h00 on Mondays to Fridays (South African time) but cannot be held responsible for any failure to be available where such failure is outside of the reasonable control of Media Works.

 

Media Works is not responsible for technical support of any external websites and where you are required to use external websites in connection with the courses; you are required to contact the support services of those external websites directly.

Where videos or other mediums are used as part of the courses, you may be required to have Adobe Flash Player installed to view them. Note that if you are making use of a slower Internet connection, your attempt to view the video may be problematic.

 

Plagiarism

 

With respect to all subjects and all courses offered, learners are strongly warned against committing plagiarism in any shape or form. For the purposes of these Terms and Conditions, which govern all course activity, “plagiarism” refers to the description of plagiarism as provided by the University of Cape Town: “the act of presenting work belonging to another person as your own. This includes but may not be limited to: lifting another person’s ideas or words without acknowledgement, whether or not that person knows of or has given permission to use the work without acknowledgement; submitting as one’s own, work which one has copied, whether in whole or in part, from anybody else, and irrespective of whether that copied work is published or unpublished, from the web or from another student (past or present) or a family member; acknowledging a source but not indicating that one has quoted verbatim (i.e. word for word); indicating, via quotation marks, that some words have been taken directly from another author, but without acknowledging the source by providing the necessary citation details; and/or preserving the general structure of a sentence, paragraph or other unit of work authored by somebody else, making minor grammatical, structural or word changes (i.e. editing someone else’s work)”.

 

We reserve the right to give learners who are found are found guilty of plagiarism (as reasonably determined by Media Works) 1 (one) written warning and if repeated by that learner at any time in the future, Media Works reserves the right to suspend and/or expel that learner from their course(s) with immediate effect. Media Works shall not be liable for any refund of any amount paid by you or any compensation of any kind in respect hereof.

Law 

 

These Conditions will be exclusively governed by and construed in accordance with the laws of South Africa, whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.

 

Updating of these Terms and Conditions 

 

We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time and without prior notice. Alterations to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s responsibility to periodically check these Terms and Conditions on this Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such alterations.

 

Consent 

 

I understand that all of the images, designs and trademarks are registered to Media Works and its associates, and hereby accept these Terms and Conditions. I undertake not to copy/duplicate these elements either directly or indirectly in any way and understand the legal implications of doing so. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Media Works for any civil action or any legal action deemed necessary against me.

 

Electronic Communications

 

Visitors to our site and/or parties who send emails to Media Works, consent to receiving communications from Media Works electronically and agree that all agreements, notices, disclosures and any other communication sent by Media Works satisfy any legal requirements including but not limited to the requirement that such communication should be “in writing” or “written”.

Privacy & Confidentiality of Student Information

 

Media Works shall take all reasonable steps to protect the personal information of users of our site. For the purposes of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000.

 

Save for disclosure to your employer where a company has registered you for a course, in the event of your employer having registered you for the course, Media Works will not divulge your course results or information relating to your performance in the course to any third parties.

 

Media Works may electronically collect, store and use the following of your personal information (amongst others):

  • Name and surname;
  • Employer;
  • Birth date;
  • Gender;
  • Country of residence;
  • Closest city;
  • How you heard about the course/s;
  • Non-personal browsing habits and click patterns;
  • Email address;
  • Work and home telephone numbers;
  • Mobile number (if provided by you);
  • IP address (if applicable);
  • ID number / passport number; and
  • VAT registration number (if applicable).

 

Media Works may collect, maintain, save, compile and share any information collected from you, subject to the following provisions:

  1. Media Works shall not disclose your personal information unless –
  2. You consent thereto;
  3. Through due legal process.
  4. Media Works may compile, use and share any information that does not relate to any specific individual; and
  5. Media Works owns and retains all rights to non-personal statistical information collected and compiled by Media Works.

 

You acknowledge and agree that unless you otherwise notify Media Works in writing, Media Works may inform third party companies or individuals about whether you have completed a course with Media Works.
